1. SCOPE OF TERMS AND CONDITIONS

1.1.The general terms and conditions apply to the implementation of courses, retreats and other events by the owner Laura Torres Prado (hereinafter called "Polarity") regardless of the event location of the booked event. 

1.2 The following conditions regulate the booking of the event. 

1.3 Polarity is only responsible for the organisation and implementation of the event. Polarity is not a travel company or travel agent.

3. MINIMUM AGE

3.1 The minimum age for booking and participating in an event offered by Polarity is 18 years.

3.2 The participation of children and adolescents must be clarified in advance with Polarity and, in the case of Polarity's consent, requires the accompaniment of a parent or guardian.

 

4. OFFER, ACCEPTANCE, CONCLUSION OF CONTRACT

4.1. The description of events on the website www.polarity.trainig constitutes a legally binding offer.

4.2. The application is made via the enquiry form and becomes binding through the payment of a deposit of 30% of the retreat price.

4.3. By booking the event the participant confirms that he/she has read and accepts the General Terms and Conditions.

 

5. ARRIVAL AND RETURN JOURNEY

5.1. The arrival and return journey are the responsibility of the participant

 

6. PAYMENT OF THE COURSE FEE

6.1. The participant books the event via the website of Polarity. The purchase price is payable immediately by booking. The prices stated on the website are final prices and include the currently valid sales tax.

6.2. After conclusion of the contract, a deposit of 30% of the course fee is due for payment within one week. The balance is always payable 14 days before arrival. 

6.3. If the participant does not pay the deposit and/or the balance in accordance with the agreed payment due dates, Polarity is entitled to withdraw from the contract after issuing a reminder and setting a deadline and to charge the participant with withdrawal costs (see below).

 

7. PARTICIPANT'S RIGHTS AND OBLIGATIONS 

7.1 The participant is obliged to provide his/her personal data truthfully and completely in the order process. The participant undertakes to promptly notify any changes to his/her data, such as e-mail address, name, address and telephone number.

7.2.  The participant must make the necessary requirements for participation in the event on his own responsibility and at his own expense. 

7.3. The participant shall abide by the rules of the accommodation. He/she is responsible for any damage caused by him/her. 

7.4. The participant is advised that Polarity expressly advises against the booking of further services, such as travel services provided by third parties (e.g. arrival and departure, train booking, flight, alternative program) before the expiry of the cancellation deadline of no later than two weeks before the start of the course due to the minimum number of participants not being reached, unless the participant has already been expressly informed by Polarity before this date that the minimum number of participants has been reached. 

7.5. Participation in the event requires normal mental and physical resilience. If the participant is undergoing medical or psychotherapeutic treatment, he/she is required to discuss participation with the doctor or therapist. 

7.6. The participant is required to inform both Polarity and the yoga teacher leader the course of any physical or mental restrictions or complaints before the start of the event. 

7.7. Participation in yoga classes with Polarity is the responsibility of the participant. 

7.8. The participant has no right to demand that the event be held by a specific teacher. In case of the unforeseeable absence of the announced teacher at short notice, e.g. due to illness or inability to attend, Polarity may provide a substitute teacher for the booked event. The replacement of the yoga teacher does not entitle the participant to withdraw from the contract or to terminate the contract.

 

8. POLARITY'S RITGHTS AND OBLIGATION 

8.1. The scope of the service to be provided by Polarity extends exclusively to the implementation of the event. Polarity does not owe any further services. In particular, Polarity does not provide or arrange any services in connection with the arrival and departure. 

8.2 Polarity is entitled to change the time schedule or content of an event or to omit individual components thereof, provided that the objective and overall character of the event are not changed as a result.

8.3. Polarity is entitled to send the participant an information email with the summarised information about the event a few weeks before the event starts. This email will also state whether materials such as yoga mats are to brought by the participant or are available at the event location. 

8.4. Polarity is entitled to use other teachers of the implementation of the event if the announced teacher is unable to attend for reasons for which Polarity is not responsible. This applies in particular in the event of the announced teacher being ill or unable to attend. 

8.5. Polarity is obliged to inform the participant at the latest tow weeks before the start of the course if the event cannot be held due to the minimum number of participants not being reached. 

 

8.6. By booking the event, the participant agrees that Polarity may book him/her comparable accommodation at the same offer price if the minimum number of participants is not reached. 

8.7. Polarity is not obliged to replace the participant for cancellation or rebooking costs for transport and hotel services already provided elsewhere. 

8.8 Polarity expressly points out that before the expiry of the cancellation deadline of no later than two weeks before the start of the course, due to the minimum number of participants not being reached, it is not advisable to book any further services, such as travel services provided by third parties (such as arrival and departure, train journey, flight, catering, program) unless the participant has already been expressly informed by Polarity before this date that the minimum number of participants has been reached. 

8.9. If an event cannot be held by Polarity for reasons other than failure to reach the minimum number of participants, through no fault of Polarity, Polarity will inform the participant of this without delay and immediately refund any payments already made. The participant has no further claims. Polarity is not obliged to refund the participant for cancellation or rebooking costs for transport and hotel services already provided. 

 

9. NO RIGHT OF WITHDRAWAL FOR EVENTS

There exist no right of withdrawal for consumers, §312g Abs. 2 S.1 Nr. 9 BGB. The booking of an event is a service in connection with a leisure activity. According to §312 Abs. 2 Nr. 9 BGB, there is no right of withdrawal for such services. 

 

10. RESERVATION OF THE RIGHT TO CANCEL IF THE MINIMUM NUMBER OF PARTICIPANTS IS NOT REACHED, RIGHT OF WITHDRAWAL BY POLARITY 

10.1. The events offered by Polarity will only be carried out if the minimum number of participants of 4 people is reached by the cancellation deadline stated in the offer. 

10.2. If this specified minimum number of participants is not reached, Polarity may withdraw from the contract at the latest two weeks before the start of the event.

10.3. Polarity will immediately refund the participant the course fee already payed.

10.4. The participant has no further claims. Polarity is not obliged to replace the participant for cancellation or rebooking costs for transport and hotel services already provided elsewhere. 

10.5. By booking the event, the participant agrees that Polarity may book him/her comparable accommodation at the same offer price if the minimum number of participants is not reached. 

 

11. SHORT TERM CANCELATION BY POLARITY

Polarity reserves the right to postpone or cancel the event for reasons for which Polarity is not responsible.

This is particularly the case if the announced yoga teacher is unable to attend, for example due to illness,  

no other teacher can take over the event or force majeure endangers of impairs the implementation of the event. The participant will then be immediately refunded the course fee already paid. Further claims of the participant do not exist. In particular, Polarity is not obliged to replace the participant for cancellation or rebooking costs for transport and hotel services already provided elsewhere.

 

12. CANCELLATION BY THE PARTICIPANT - CANCELLATION POLICY DURING COVID-19 

 

12.1 CANCELLATION OF AN EVENT BY THE PARTICIPANT 

The participant can cancel a booking directly affected by COVID-19 up to 14 days before the start of the event free of charge or reschedule it to another date. In case of rescheduling to another date, additional costs are possible depending on the season. 

For cancellation within 0 to 14 days before the arrival, Polarity may charge a lump-sum compensation. Compensation is calculated according to the date of receipt of the participant's cancellation notice as a percentage of the booking fee as follows:

14 days to 0 days before the start of the course: 50% of the booking price

 

12.2. CANCELLATION OF ACCOMMODATION BY THE PARTICIPANT

The participant can cancel a booking of his/her individual yoga vacation directly affected by COVID-19 depending on the accommodation free of charge or reschedule it to another date. In case of rescheduling to another date, additional costs are possible depending on the season. 

Beach apartments: free cancellation up to 2 days before the arrival day.

For other accommodation (Hostel, deluxe beach apartments, villa, finca) the respective owner is responsible for the cancellation policy.

 

12.3. CANCELLATION OF COURSE RESERVATION FOR INDIVIDUAL YOGA CLASSES

Cancellation conditions are so chosen by high rent of the event locations. We recommend to take out a travel cancellation insurance, which is not very expensive. 

The participant can provide a substitute participant until the beginning of the booked yoga retreat, who will take over the rights and obligations of this contract. 

 

13. SUBSTITUTE PARTICIPANT

The participant can provide a substitute participant until the start of the booked event, who will take over the rights and obligations of the contract. Polarity can object to the change in the person of the participant if additional costs arise due to the participation of the person or if the person does not meet the special requirements in relation to the event or domestic/foreign legal regulations prevent participation. The participation and the substitute participation are liable to Polarity as joint and several debtors.

 

14. LIABILITY

14.1 Polarity assume no liability for damages, as well as physical damage. 

14.2. Polarity assume no liability for the damage or loss of personal valuables of the participant.

14.3 By booking the event, the participant confirms that he/she is taking part at his/her own risk.

 

15. DECLARATION OF CONSENT IN PICTURE AND VIDEO RECORDINGS 

15.1. Polarity reserves the right to take pictures and videos during the event of classes for the use and publication of such recordings on its own website and social media, as well as for passing them on to cooperation partners of Polarity (teaching stuff, seminar hotel,...) for use and publication on their website and social media for purposes of advertising and describing the services. 

15.2. The participation hereby declares his/her consent to picture and video recordings of him/her in accordance with section 15.1. of these terms of use. 

15.3. The participant may revoke his/her consent on site before the picture and video recordings are made 

vis-à-vis the person making the recordings. 

 

16. PLACE OF JURISDICTION 

16.1. The place of jurisdiction for fully qualified merchants, for persons who do not have a general place of jurisdiction in the domestic country, as well as for persons who have moved their domicile or habitual residence abroad after conclusion of the contract, or whose domicile or habitual residence is not known at the time the action is brought, is the registered office of the event operator. All prices and texts are subject to misprints or changes.

16.2. All declaration required under travel contract law before the arriving and after departure are to be addressed to Polarity.

16.3. The place of jurisdiction is Cádiz.
